Washington State: court decision may have significant implications for Tribal Economic Development

A recent decision by a United States District Judge rules that taxation on specific tribal developments that include partnerships with outside non native entities has possibly thrown a wrench right into the diversification process for Tribal Economic Development.

At the center of this decision is the framework of the operating and development structure between the Chehalis Indian Tribe and Great Wolf Resorts Inc.

It will be interesting to see the challenges of this decision and the outcomes. I’m certain there will be no lack of commentary and thought about the pros and cons of this decision. It’s interesting the decision was handed down just prior to the annual tribal gaming industry trade show in San Diego, (National Indian Gaming Association). Maybe this issue made the topical laundry list at the last moment. Let’s hope so.

Challenges to Tribal Sovereingty? Bingo, Class Two Machines, Land into Trust Applications?

It seems there are many issues in place all across Indian Country that tend to compromise Tribal Sovereignty.  As future executives or those of you that occupy and lead, these issues should be kept at the forefront of discussions, planning, and rights campaigns.

There is ample information about the use and placement of electronic bingo machines in non native casinos. I wasn’t aware that states were moving into that arena. I thought under IGRA those were Class Two devices.

Thank You Nez Perce Tribe and the Staff at Clear Water Casino

I had a great time working with you at the workshop March 4th at the event center. It was my pleasure meeting all of you and discussing the challenges that managers and supervisors meet through out a typical workday or week. I had a great time talking about ideas that would be beneficial. I found it interesting that you already have plans to amend or change processes and procedures that might be constructive for you staff and “Worker Bees”.

I urge you and your teammates to stay in touch and keep that dialogue we saw in the workshop going. Take time out to “talk shop” and bouncing ideas off one another. Stay connected to each other and leverage that strength and capacity you have as a group and as professionals.

What effect is this going to have on the future of class two gaming? Will operations like these spring up and launch a new form of commercial gaming? What happens to Mississippi gaming operators now?
